DATA PRIVACY POLICY
1. Privacy Statement
The Society collect, process and store personal data about you when you access your membership profile, including membership dues and CPD units earned, through the Society website. It also includes access to other features such as online courses and download of materials or enter any contract with the Society provided that you have given your express consent.
This privacy policy has been prepared to better serve any person who access the website to inform them on how their personal data are being collected, used and secured by the Society.
Please read our privacy policy carefully to get a clear understanding of how the Society collects, uses, protects or handles your personal data in accordance with Republic Act No. 10173, or the Data Privacy Act of 2012, and its Implementing Rules and Regulations (collectively, the "Data Privacy Act").
2. Collection of Personal Data
The Academy collects information you provide directly to it, such as when you attend or participate in any of its events; register, create or modify your membership profile, including access to membership dues and CPD units earned; respond to surveys, access online modules and/or download articles from the website; contact the Secretariat; enter into any contract with the Society; or otherwise communicate or interact with the Society.
The following personal data may be collected: your name; age; birthday; nationality; civil status; contact information such as permanent residential address, mailing address, email address, landline and mobile phone numbers; information regarding practice, such as number of years in practice, specialization, area of expertise; clinic information such as clinic address, landline number and schedule; educational background including school and year graduated; family background such as name and address of spouse, children and parents; and name of beneficiary for benefits that can be collected from the Society.
3. Use and Processing of Personal Data
The Society may use and process the personal data collected about you to participate in its events and activities; provide means of communication such as announcements and newsletters; and update your the Society membership status.
At all times, your personal data shall not be used or processed for any purpose that is contrary to law, morals or public policy.
4. Sharing of Personal Data
The Society may share personal data between and among entities* comprising the same to enable them to provide its members quality services.
The Society may also share personal data in accordance with any order from any relevant government agency as provided by law (i.e. Department of Health, Philippine Health Insurance Corporation and related agencies); consultants; partner organizations; and other service providers who need access to relevant information to carry out work and/or programs on behalf of or in partnership with the Society.
5. Storage and Protection of Personal Data
The Society has instituted policies and procedures which intend to protect personal data which it has collected and continues to collect. These include securing any document containing personal data, requiring the execution of non-disclosure agreements by its employees, consultants, suppliers and contractors, among others.
The website is scanned on a regular basis for security holes and known vulnerabilities to make any visit as secure as possible. It uses regular Malware Scanning. The personal data is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the personal data confidential.
In addition, all sensitive information supplied is encrypted via Secure Socket Layer (SSL) technology. The Society implements a variety of security measures when a user submits or accesses their information to maintain its safety. All transactions are processed through a gateway provider and are not stored or processed on our servers.
Will there be a risk of unauthorized disclosure of personal data, the Society commits that the foregoing safeguards are sufficient to prevent the occurrence of such risk and further commits in updating and improving such safeguards in order to protect its members’ personal data in compliance with the Data Privacy Act.
6. Member’s Rights Under the Data Privacy Act
As a data subject, a member has the following rights under the Data Privacy Act:
- Right to be informed of the collection and processing of personal data, the purpose for which they will be processed, among others. Thus, the member is required to read this privacy policy before giving his/her consent to the collection and processing of his/her personal data. If members have questions, they should not hesitate to ask questions or clarifications and may also contact the Data Protection Officer of the Society;
- Right to object to the processing of his/her personal data. The member is given an option or opportunity to withhold consent to the processing of the personal data whenever the Society communicates with him/her or by notifying the Data Protection Officer;
- Right to have reasonable access to his/her personal data by notifying the Data Protection Officer;
- Right to rectify or correct any inaccuracy or error in his/her personal data by submitting a request for rectification or correction to the Data Protection Officer;
- Right to suspend, withdraw or order the blocking, removal or destruction of his/her personal data in accordance with the requirements of the Data Privacy Act. The Data Protection Officer should be notified should a member wish to exercise this right;
- Right to obtain a copy of his/her data in an electronic or structured format if the same is processed by electronic means and in a structured and commonly used format by submitting a request to the Data Protection Officer; and
- Right to be indemnified if he/she incur damages due to inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of his/her personal data.
7. Changes to the Privacy Policy
The Society may change this Privacy Policy from time to time. If the Society makes any significant change in the collection, use and protection of personal data, the Society will provide notice through the services or by some other means, such as email.
It is encouraged that members periodically review the Privacy Policy located at the Society website for the latest information.
8. Consent
The Society will secure consent from the member prior to collection and processing of his/her personal data, or as soon as practicable and reasonable in order to ensure continuation of access to services provided by the Society. Before giving consent, the member will be provided with an opportunity to read and review this Privacy Policy.
If the member consent to the collection and processing of his/her personal data in accordance with the Privacy Policy, such consent shall be valid for a period of ten (10) years from the date such consent was given or such longer period as may be required by applicable law or when necessary as provided by the Data Privacy Act, or unless the member expressly withdrawn such consent.
By signing the accompanying sign-up sheet or ticking the “Agree” button if the personal data was collected manually or electronically, respectively, the member expressly gives consent to the collection, processing and storage of his/her personal data as provided herein.
